Removal Of Parents Name In Pwdva Case

What are the grounds on which it is prayed to remove parents name in pwdva case...after summoning if they were living together with family during matrimonial life of son...and what is the best way to put this application in front of court ...is it recall of summon order or name removal application or summon order challenge ..

See Section 25(2) of DV Act, you have to file application under this section stating various reason as to why your parents should be discharged from the present case. It will help you challenge further if the application is rejected by the lower court.

Do seek a detailed legal consultation from a lawyer having expertise in matrimonial Litigation cases. Application for deletion of name from array of parties can be filed depending upon perusal of contents of complaint filed. An appeal against the summoning order can also be filed before Sessions Court

there are no grounds on which you can remove the name of parents in DV act if the parents name is already given in the complaint by the complainant and they were living with there son during matrimonial life you have to prove that the complainant is make false statements which can only be done during cross-examination because dv act cases are actually handled sensitively and judges usually don't grant relief that easily

You have to file an application as parents are not bound to maintain daughter in law . It should be strongly contested by court . If trail court does not remove then file appeal before session court . In alternative parents should live separately from son & in such situation their name shall be removed
