Q: Can a spouse cross examine in divorce case

Can a spouse cross examine the other in divorce case? I want to remove my lawyer who has been colluded and take part in proceedings as party in person. Now the lawyer is reluctant to give me NOC . Is there any specific format to be filed before judge to appear for party in person and remove old lawyer or have to say to judge orally. What are the chances of success in appearing party in person in divorce case and I have all the necessary proofs to substantiate. Plz guide me

Yes you can do so, however I would highly recommend to engage a advocate for following reasons-1- Judge may not entertain you in the proceedings as technically difficulties can only be understood by advocates2- you may end up making the best case a bad case for you and then at appellate stage you will have to face consequences.3- Law from google is different from real law, while in case of cross examination, objection at relevant point, 63b or 65b certificate at the time of giving producing online documents, etc. may be essential but you may miss and then it will cost you hefty.Please engage an advocate for best results.



Q: 2nd time Suspension with out any relief given by Court and without an

I was served minor penalty against which I Filed in CAT , but my Advocate raised the Question on Authority so Bench set aside all the orders but gave liberty to Department to enquire again if so.on 09/08/2024.I was suspended for 90 days again on 16/05/2025 after 10 months of judgement with out giving any relief given by Court .Now last 2 months I have not been given substances allowance.Now my suspension has been extended for 180 days.What relief urgently I can have

You first write a letter addressing to the disciplinary authorities outlining your need and right to receive subsistence allowance, however it would either be rejected or not answered, hence as a last and best resort you have to approach CAT against non payment of subsistence allowance as a matter of right.



Q: Removal Of Parents Name In Pwdva Case

What are the grounds on which it is prayed to remove parents name in pwdva case...after summoning if they were living together with family during matrimonial life of son...and what is the best way to put this application in front of court ...is it recall of summon order or name removal application or summon order challenge ..

See Section 25(2) of DV Act, you have to file application under this section stating various reason as to why your parents should be discharged from the present case. It will help you challenge further if the application is rejected by the lower court.



Q: A driver hit my bike and then fled the scene.……………………

On Monday, a scooter crashed into my bike in Vijay Enclave, damaging my silencer. I asked the rider for his insurance details, but he claimed it wasn't his bike and promised to pay for the damages the next day since he had no cash. I collected proof, including his number and a video of the incident. Now, he isn't answering my calls and is delaying the matter. There were two passengers without helmets, and I regret not filing an FIR initially, as he seemed decent at the time.

You can still file an FIR with the nearest police station, explain the delay in filing the FIR. Time is essence however delay in filing of FIR is not barred or bad in law. Please the necessary steps immediately
