My sister's case. Her husband and his family very dominanted.

My sister's can't live there anymore. Can we file case for divorce?? Or first we have file case for domestic violence??? She have 7yr old child. He don't want give divorce. But it's happening from her marriage till date in every 3-6 month she fed up.. what we do?? Plz suggest thank you
She can file Domestic Violence case against husband and his relatives.In Domestic Violence case she can claim maintenance, shared house, compensation and protection from harassment from his husband and his relatives.

Is your sister still living with her husband ? If she is living with her husband, she first needs to live separately from him in order to avail any legal remedy available for her. After she starts living separately and depending on the facts of the case, I would suggest what can you do after that.

First of all you can move with Petition for Domestic Violence Act frnd. Once they appear in court there will be proper conciliation and if matter gets solved its well and good or otherwise then you can file Petition under section 13(1) of Hindu Marriage Act.
