In 498a,406,34 ipc accused has Bw warrant and next hearing date is 11-11-2019 on that date accused will be abroad and will not reach court but now complainant want her case withdraw anyhow to release accused from charge in trial court what will be right and simple process to save her time So that the case can be concluded in one go and will accused be affected from this or not.......? Thanks 1. She can withdraw her case from trial court from one application. 2. If accused files application for discharge and compalinant gives no objection application then court will do withdraw her case...?

easiest and fastest way is to approach High Court for quashing of FIR.... on basis of no objection/settlement between the parties. in case both the parties are available on the same date FIR is quashed.

Hi, Parties can file joint petition for quashing of FIR Section 482 in The Code Of Criminal Procedure, 1973 Saving of inherent powers of High Court. Nothing in this Code shall be deemed to limit or affect the inherent powers of the High Court to make such orders as may be necessary to give effect to any order under this Code, or to prevent abuse of the process of any Court or otherwise to secure the ends of justice. Hey that's not possible as the chargesheeet in the instant matter had been filed before the court. If the settlement had reached upon than better you file quashing before the concerned high court for speedy and effective resolution to your problem. for complete advice and support Meet in person at office.
