I have filed for dowry case against by husband, m-in-law father-in-law. F.I.R has been registerd & these 3 people's names(ie accused) is there in the F. I R. But in the chargesheet filed by police ,only husband name is included & both in-laws names they have not included. I I have sufficient evidence to prove that they have taken dowry, mental & physical torture, harassement to bring more dowry & threatening. So what should I do nxt to include both in- laws names in the dowry case? Please suggest me.
The Code of Civil Procedure, 1908 Order I Rule 10, empowers the court to strike out the name of any party improperly joined whether as plaintiff or defendant and also when the name of any person ought to have been joined as plaintiff or defendant or in a case where a person whose presence before the court may be necessary in order to enable the court effectively and completely to adjudicate upon and settle the questions involved in the suit. It enables the court to add or substitute any person as a party at any stage of the proceedings.

Dear Madam,
If you have enough evidence in the charge sheet then you have an option to file application under Section 319 of CrPC to get summon your parents-in-law. Such application is to be filed public prosecutor who is your advocate. Please get copy of charge and read every statement of the witness and prepare such draft application and get it filed through public prosecutor.
