I have completed four years of my marriage but I stayed one month in my in laws house and after that I came back my home as I used to be beaten by husband and his family and frequently they demanded dowry also.It’s been more than 2 years now I am keeping unwell and I was not aware that my dad used filled my NIL itr. Hence in my court I my submitted that I don’t filled my itr as I am not working. But when I cross checked with my father then he accepted the facts. After knowing the facts I made apology letter along with my itr I submitted my itr in the court. Earlier my father used to bear my all expenses. Now my father passed away three months back and I need money for my treatment. But what should I do ? So that I can get maintenance.

If the behaviour of your husband is intolerable towards you then you can always file for divorce against him. You have got so many options. You can also file for maintenance under section 125 CrPC or a DV case against your husband and in-laws and claim your monthly maintenance. For more legal assistance I am just a call away.

There are various legislative enactment which may be availed by wife against her husband and in laws such as maintenance which is prescribed under different statutes, DV case, state case u/s 498A and so on as per the facts and circumstances of each case. you should file maintenance case first.

First of all you should file DV petition against your husband and your in laws and there is no limitation bar for you to file maintenance from your husband so you can ask for maintenance there is no issue in filling the maintenance case. That is the most fastest remedy you can achieve

You can file the suit before the concerted court. After examining the case and listing the parties, the court will give the judgment in your favour. The only thing you have to do is to go to court and file the petition through your advocate.

have you filed by case against your husband and his family? if not then that should be the first step. also you did not mention the work which is done by your husband. maintenance can only be available if you get a divorce else it is the duty of your husband to take care of you and your health
