My wife under inflcunce of her father has accused me of Mental and physical cruelty for Dowry demands,sexual harrasment, domestic violence. She lodged an FIR on 14th Aug 2019 under section 498A,323,377504,506,3/4 in her hometown Rampur UP. She left my house at Noida after arguments over a trivial domestic issue on 5th Aug 2019 with all her belonging including her jewellery. My parents who dont even live with me are also accused in FIR. I have applied for AV in Rampur court. How should I proceed. Does she require any medical proof or anything to prove her allegations or court will just agree to what she says. This case is to harras me and my family. Is there any possibility I can get this case transfered to Noida from Rampur where this incident hapend. What are the ways to prove her allegations wrong in court.Kindly suggest.

Firstly investigation will be done, if anything real will be found then only proceedings will start... you need not to worry, even law does not convict an innocent, you just try to collect evidences against her, as she may have something against you people...You can also get that FIR quashed from the High Court... for further details you can call me...

you can file a writ petition for quashing the FIR lodged against you in Rampur before hon'ble high court allahabad. you can also apply for anticipatory bail before district judge Rampur. But first of all you should send a legal notice to your wife for restitution of conjugal right under section 9 of hindu marriage act and thereafter file a petition against your wife for restitution of conjugal right under section 9 of hindu marriage act. basically wife have much rights in law for harassing of husband. but first you need to protect you and after that u make a defence in her case. first of all you need to file a case under section 9 of hindu marriage act in noida court. this case much protect you and help you for defence on her case.
