obtaining succession certificate

What is the best way to get succession certificate as soon as possible? How do I go about it? Please tell me the steps. I am from Mumbai. Let me know if you need more information.

There is no shortcut process of obtaining a succession certificate. The certificate is granted by a competent civil court after you file an appropriate petition mentioning the details of legal heirs, property etc.

The court will thereafter issue notices to all the legal heirs to attend the proceedings. You can get the notices served quickly by getting the vakalatnamas of all the legal heirs filed in court. By this manner you can save time in service of notice. The rest will be done as per the procedure only.

Exemption of personal appearance would be a discretion of the court however you may get a relinquishment deed signed and registered signed by all the legal heirs whom you have mentioned. No they have to at least appear in person once ..n there statement will b recorded ….
You can also request court for virtual or video hearing ..then it’s discretion of court .. plz b in touch with us asap

Firstly, the exemption for personal appearance is on the discretion of the court. Secondly, if you need a succession certificate for the transfer of bonds or shares only then the presence of all the legal heirs would be required but in case you want to transfer the a property or so then a legal heir certificate would be required for the same and lastly, for transferring the right to one legal heir, you can get the NOC or relinquishment deed signed in favour of the said person.

The answer is yes. You have to apply a document for exemption of their appearance and along with that a person will appear on behalf of all the heirs.
