For divorce and dowry case against family members

I have been married since 2years,but most of the time i have been staying in my mother home and now its almost 3 months i am staying in my maternal house,my husband is a drug addict and a drunker,he abuses me alott and torchers me mentally and physically,he is not interested in me,he had taken cash amount many times after marriage almost 9 lakh but we dont hav any proof of that only withdrawl receipt from bank,but i have his recording saying he takes drugs and he is sorry for that everytime he does that and start taking drugs again,my mother has also given large amount to them in marriage also,he beats me also after that i havent go back to him,I want to ask can i file a case against him for abusing me physically and mentally even if its been 3 months since he beats me as i dont have any proof of that now,and i want divorce And my money back

You have been tourtured by husband addiction, if you are or can be independent or you may be supported by your family members then yes you certainly go for divorce.

as a have read Ur problem in this manner Ur been harrased and it's Ur calm and patience tht you are still there with your husband . so for this matter as you want will be done there will not be may problem in this result which you want. but tht is only possible when you move with legal way in tht manner your money ,your allimony and your expenses all your husband has to repay it to you.

Query perused. Yes you can take legal action against your abusive husband and sort various reliefs available to a married woman in India. You can file a domestic violence complaint with the concerned magistrate and seek maintenance, separate residence and protection order etc. You can also file a case under section 498A IPC for dowry harrassmentbefore.
