Contents of an affidavit containing transfer of power of attorney

Hi, There is a certain property in the name of my paternal grandmother at Ratnagiri, Maharashtra. However, my grandmother and my father have passed away. The property now belongs to two paternal aunts and my mother. However, my mother is ill and cannot travel to Ratnagiri from Mumbai for any of the formalities of the property transfer. Hence we are to make an affidavit so that my name is added in place of my mother's. What should be the content of this document? Kindly guide me... Thanking you in anticipation... Religion: Hindu

hello,
if the proerty is paternal and you father is passed away, it should come to both of your names. not only tour mother. and if your mother's name is already added to the property, then only affidavit will not work. either you have to execute a gift deed. or purchase a property from your mother. for more detaila I need to check the documents.

I understand that one of the joint owner in the property is your mother and you need to register the documents so that title to the property transfers legally in your mother's and aunts name. In this case you can take power of attorney from your mother authorising you to register the documents with the sub-registrars office on her behalf.

Registration of documents relating to immovable property is compulsory under law and one cannot escape it. What you may do is get a power of attorney executed & registered in Mumbai by your mother giving you authority to handle affairs of the property in Ratnagiri and elsewhere on her behalf. Using this power of attorney you may be able to execute further transactions under her authority. My advice to you is to consult a lawyer in person for drafting, executing and registering power of attorney.
