Would remarriage after divorce affect separate court proceedings?

My ex-wife had filed a divorce petition 2.5 years back. six months back a criminal case was registered against her and others under section 342,354A,506 and 34 as she quarelled with a distant relative of mine under the allegation that I am having an affair with that girl. She made a complaint to local police station on this ground. No case was registered on her complaint but on the complaint of my relative the above criminal case was registered against her and four others. I am planning to file a defamation case against her under section 499/500 of ipc. Can the merits of the defamation case be affected if I marry the said relative after 90 days of my divorce with ex-wife. Please guide me in detail.

After divorce of you marry with any women then it have no effect in Amyaaner with your ex wife.

Of you file suit for recovery for defamation then it have no effect in your future married life with anyone. For more discussion youau fix appointment so that we may discuss in detail.

This question of yours is sufficient to affect your case. Consult your counsel and proceed with litigation carefully. Defamation case would not serve your purpose. Check out reason for filing defamation.

There are lot of queries involved to answer your question. And certainly it seems that if you would marry (if no appeal is pending against divorce decree) it may affect your case of defamation besides affecting the proceedings initiated by your relative against your ex-wife, if same are not culminated yet.
The exact stages of earlier & pending litigations is must to check before steeping further in advising you as well as in taking any further legal recource besides other clarifications.

Defamation is effective against your ex-wife only if you prove her wrong on her statement against your relative. If you will marry with that relative then the statement of your wife becomes true and defamation case shall not stand on its legs. So in my views, you need to wait for few months, if you want to teach a lesson to your ex-wife, otherwise leave defamation case and marry as per your wish. As regards the criminal case, that will not be effected with your marriage. regards Adv Malhotra
