Without divorce compensation from husband

If husband absconded from home and he is not giving any money to run the house and not responding to phone and saying he will proceed to legally but not doing anything. Whether my cousin should lodge complaint against him or how she proceed to get compensation without divorce

Hi...wife can file a case for maintainence against her husband and she can ask monthly maintainence for herself and her child. And it is duty of the husband to take care of his wife band children. and it is the duty of husband to care of his family.

You can ask your cousin to file a maintainance application under section 125 of criminal procedure code and seek for monthly maintenance based on the income which your cousin's husband is earning.

Better She can file a maintenance petition instead of filing the complaint. As you told he is absconded. On the date of absconded date she has to file a complaint. Now it seems late in filing absconding case.

Let her to file a case for Maintenance. She can get Maintenance without divorce.

she can just file a case for maintenance in family court under section 125 of crpc and even after order he does not pay his salary, income or property can be attached and your cousin can get maintenance. there is no need to apply for divorce, if he applies it is difficult for him to prove the grounds on which divorce can be granted, so without waiting file for maintenance.
