Hi I want to withdraw my sec 9 case as me and wife have filed for mutual divorce and first motion id done.I want to know withdraw my sec 9 case. Kindly let me know how to withdraw it?
Yes.. surely it can be withdrawn by the party filling the same at any point of time. There is no such thing that it can't be withdrawn or not allowed to be withdrawn since even in cases of settlement and for getting divorce or living together the said petition under section 9 is withdrawn for further clarification please feel to contact me

Write an application to concern Hon'ble Court for withdraw of your case and mention on which group to withdraw. If your wife has been come to your home for stablish familiar life then give her an affidavit attached with an application submitted to court please.

if you want to withdraw the case it will be in family court. your first motion is done you have to separate the cases section 9 is restitution of conjugal rights it has to be withdrawn then ull see then the second motion will take place
