Wish to know law regarding emotional abandonment

I am married for the last 2 years now and now me and my husband are staying apart for more than 1 year. My husband emotionally tortured me by not providing a good standard of living in Mumbai despite having a good income.Never carried out anything as per my wish and when questioned would turn the table around me.Did not provide me simple pleasures of a married life (taking out for dinner on special occasion/calling me throughtout the day).This resulted in huge fights. He never came forward to resolve fights but gave me silent treatment staying under same roof for 4-5 months which created immense mental impact in me.Made derogatory statements about my lifestyle and job.Post which he shifted his city saying company has transferred him and has not contacted me ever since then.I have under immense mental torture and I wish to file for a divorce now.I want to know if the above reasons are strong enough to file for a divorce and demand alimony.

yes, the above reasons are strong enough for filing for a divorce. you need to first initiate some action from your side by sending a notice with all the facts and allegations. thereafter, you can file a dv application and seek maintenance in the same. subsequently you can also file a divorce petition under the ground of desertion and seek maintenance in that too.

You can file divorce petition on the ground of desertion.
And also claim interim maintainence and also permanent alimony in divorce petition.
And also you can file Domestic Violence case against him.In DV case you can claim shared house for house accommodation.

Dear queriest, yes the grounds you had mentioned are sufficient enough to file divorce and to demand alimony and as you have mentioned that your husband doesn't talk to you enough after staying in same roof and also doesn't give you a good standard of living, which amounts mental cruelty and so you file for divorce under the provisions of Hindu Marriage act under the grounds of cruelty.
