will court consider this case and grant divorce

01-Oct-2023 (In Divorce Law)
HI Am married just 6 month before (feb ,2020) , i recently diagnosed (june 2020) with lymphoma cancer which is highly curable and chemotherapy is going on and the treatment has very good response . before my marriage i got hospitalized with abdominal pain and doctor conducted several tests and told that it is just the infection lump which goes of in few months , and then i got married after 3 months . but the lump did not reduce and so i again went to hospital(after marriage) to get it checked unfortunately this time doctor/tests confirmed that its lymphoma cancer. my wife is asking for divorce and they are about to file a case to get divorce from me 1 will court take this scenario (cancer) in the petition and approve for divorce even if my health recovers ? 2 if court wants to grant divorce then do i need to pay her any asked amount ?

in this case as the said cancer is curable and as the marriage has taken place 6 months it is not possible to get DIVORCE in this case unless you agree, if she files you can contest if you want, further if she has no source of income and if she is unable to maintain herself then you have to pay her alimoy or maintenance, further it is not how much she demands you have to pay but the court will decide looking to financial condition of both husband and wife, like income, assests etc.

if the spouse is not happy with you then she can take divorce it's her wish but she has to prove her case at the court of law to get divorce for example cruelty, harrassment or disturbed marriage etc. About paying alimony depends on her survival issue means if she is educated and earning well then she can't demand unreasonable amount from you. Its again too early to tell as it depends on adjudication process at court.

We need to see the ground raised for divorce. Having disease is not a ground for divorce and cannot be entertained by courts at all. You are not liable to pay anything contest the divorce petition at the earliest.

the maintenance depends on the status and education of the wife! That can a ground to dissolve the marriage but cannot be a sole ground! you consult an advocate for suggestion and advice! A lot of aspects eill be considered while granting divorce
