Wife not returning to matrimonial home & forcing to file for divorce

My wife have not returned to me since last 7 months from her mother's place. And when she was with us she was torturing my family so that we will ask for divorce and she can make some money out of it. Now she has not returned and maintaining records of expenses so that she can claim.. And we don't have any child

1) If she is working women she wont be entitled for alimony.

2) If your marriage is happened in the less than 1 year, than you can go for annulment of marriage.

3) otherwise you can file divorce or mutual consent divorce.

You first send her legal notice if you want she to come back to stay with you and apply in court for divorce. You have to explain your complete story with lawyer, which will help to draft divorce petition on grounds available to you.

Dear Client,

You may file a petition for conjugal rights and then followed by divorce since she is not coming to join you from her parents home. you have full rights to ask her to join you and if she does not then you can take action against her.

She cannot force you to file a divorce against her.
The call to file divorce has to be taken you without any force from anyone.
It is now, that you have to decide required to be done.
Send her a Notice or else file Restitution of Conjugal Rights on your wife.

Dear Querist, you will have to write letters to your wife demonstrating that you love her and she should come back to her matrimonial home.
If she returns well and good or else this letters will help you in contesting divorce proceedings.
