Wife left within a year of marriage without saying anything

07-Aug-2023 (In Divorce Law)
I have been married less than a year. There have been many verbal fights and altercations between us during this period. She has left the home now. I feel severely disturbed and anxious. I am not at all happy in my marriage and it has been very hard to adjust with her. If she does not return, at what point should I consider divorce? With the future looking very uncertain, I wanted to know what are the possible legal courses in the short and long term for someone in my position.

You can always file a petition under section 9 HMA to call your wife back into the matrimonial life. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Dear Client The resource depends on your motive, if you want her to come back, you will have to move an application for restitution of conjugal rights, in case you want to seek divorce, it’s best to proceed with a mutual consent. Please make sure you also lodge an NCR for protecting yourself and your family from any false allegations. Feel free to get in touch to discuss further.

Hello There is no point of time where you can assume an implied divorce. You have to file the divorce petition before the concerned court. In case both of you are certain of getting divorce then a joint application for divorce can also be filed before the concerned court
