Wife hid her previous divorce. Came to know after four months of marri

23-Jan-2023 (In Divorce Law)
My brother Met his wife on Facebook in 2019. Got married in 2021. Nothing from her family. We have 20 tolas gold to her. After 4 months brother got through some photos where she had a sindoor on forehead. On enquiry it came out that she had been in a marriage for 5 years and then got divorced mutually. The lady took all gold and money and fled. After 2 months again came back on karvachauth. Resided for 15 days n then again fled with some more gold. Her family was informed immediately. Police report not filed due to family's name. nShe is living alone in Jaipur. Is concealment of previous divorce a ground for divorce? She filed a bogus police complaint where she stated that she took away all the gold and that the husband should not contact her or her family ...and then withdrew the same complaint. No cases filed by her till date but asks for her expenses by calling. What should be the legal action? Both r Hindus.

Sir, your Brother's wife had done fraud because Concealment of fact would fall under the category of fraud and it would lead to annulment of marriage under section 12 of Hindu Marriage Act. You can take this ground for declaring the marriage void. She is also liable for cheating. Kindly , discuss this matter with me in more detail such that i can help you.

CONCEALMENT OF DIVORCE IS NOT A GROUND FOR DIVORCE BUT IT CAN SAID THAT THE MARRIAGE IS PERFORMED ON THE CHEATING. YOU SHOULF FILE FIR AGAINST THAT LADY UNDER SECTION 420 IPC FOR CHEATING AND TAKING AWAY GOLD.

concealment if previous divorce amounts to fraud which is ground of Divorce. Besides, her conduct itself is sufficient to break matrimonial tie. you can file divorce. So far as criminal complaint is concerned, entire facts need to be discussed.
