Wife adultery and filed DV case

Hi , My wife was cheating on me and filed a DV case against me. Can I file a case against adultery and moreover she is demanding a lot of money for mutual closure. Advise should I file a case against cheating and should go ahead with divorce mutually or on ground of adultery to reduce the maintenance.

You can contest the DV case with proper evidence and file for divorce on the ground of adultery under Hindu Marriage Act, which may help reduce maintenance. Adultery can be used as a ground for divorce. Mutual consent is an option if terms are fair.

If your wife is living in adultery then you can present evidence in the court and get an order in your favor in the maintenance case. You can file a petition for divorce in the Hon'ble Family Court, your grounds are good and you will also get a divorce decree from the court.
