29-Jan-2026 (In Divorce Law)
We filed mutual consent divorce under 13b with their own lawyers appolnted. But my wife's lawyer strategically asked my PAN card soft copy as he involved in filing ecourts petition entry in Courts software on the day of joint petition filing. My lawyer also asked me to give. Does PAN card is mandatory for mutual consent divorce? Initial according to agreement, she agreed to not take any permanent alimony or maintainance in future. But does court ask me to disclose any ITRs? Does PAN required?

Dear Sir, Under the Supreme Court ruling in Rajnesh v. Neha, parties are technically required to file an Affidavit of Assets and Liabilities. Even if alimony is waived, the court may want to see that both parties are financially independent enough to sustain that waiver.

Hello sir, PAN Card is not legally mandatory for filing of a mutual divorce. The other government ID cards like Aadhaar is usually sufficient for ID/ address proof in a divorce case. Kindly give further information regarding the reason given for asking the PAN Card

Alimony and Court Discretion Even if there is an initial agreement to waive permanent alimony or maintenance, the court requires full financial disclosure to ensure the settlement terms are fair and that no party is being financially disadvantaged. The court has the power to scrutinize the agreement and may still ask questions regarding your financial status based on the disclosed ITRs, especially to ensure that the agreement was made voluntarily and fairly by both parties. Failing to provide complete and accurate financial information, including ITRs, can lead to legal challenges or potentially invalidate the divorce decree later.

Not necessary to produce a pan card. But you must produce a aadhar card for mutual divorce petition filing. Better you confirm before the court in which jurisdiction family court you are filing a case. If you need any help please contact me

No not required. PAN Card is not mandatory in mutual consent divorce. There is no provision in the Hindu Marriage Act, CPC or any Family Court Act. Sometimes lawyers ask for identity proof as PAN Card but you can refuse and give some other ID proof.
