Q: FIR Filing Criminal Complaint for a Civil Matter
If a FIR has been filed by a person against someone for a civil matter, painted as criminal matter. The complainant has threatened to destroy lives of accused and people related to accused, a few days before filing FIR and some evidence is there that the accused were involved with the complainant in a civil/personal matter and this has been only done to escalate the issue out of ego. During the course of these proceedings the complainant tries to threaten the accused multiple times indirectly.
Advocate Dhruv. K answered
You can challenge the FIR in the relevant High Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) or Section 482 of the old CrPC for abuse of process. You should also immediately file a police complaint or initiate court proceedings regarding the complainant's ongoing threats

You can obtain a certified copy of the order by applying directly to the court or authority that passed the order in RA(BNA)361/2016-17.Legal procedures often require this certified copy to accompany any appeal filed. If the case is online, a copy downloaded from the official website may be acceptable, though a certified copy is generally preferred.

Advocate Dhruv. K answered
A registered Power of Attorney (POA) generally authorizes the agent (husband) to act on behalf of the principal (wife) for property transactions.Sub-registrars in India have discretion and may require both parties to appear if they believe the POA is insufficient or suspicious. The Indian Registration Act permits agents to register documents, but the registrar must be satisfied with the authenticity of the POA.You should directly approach the specific Sub-Registrar’s office to confirm their local requirements and ensure the POA is duly registered and comprehensive.
Q: in a cc case 319 crpc detailed answer required interested only answer
in ongoing 319 hearing, respondent are now claiming that they did not receive the revised petition. However, they have already filed a detailed counter addressing the contents of the petition. The Court docket dated 18.06.2026 records that the petitioner side was heard and the respondent side was heard in part. In these circumstances, does the respondents' present stand appear false and intended only to delay the proceedings and divert attention from the merits? .. how to respond to this court
Advocate Dhruv. K answered
The respondent's claim of non-receipt appears inconsistent with the filing of a detailed counter-affidavit, which explicitly addresses the contents of the revised petition. The court docket records showing the respondent was heard in part suggest active participation, contradicting the assertion that they were unaware of the petition's specifics. To respond, you should file a reply highlighting these contradictions in the court records to demonstrate that the claim is likely a delaying tactic rather than a genuine procedural grievance.
