Dear Sir, A wife can file for divorce in any one of these jurisdictions: Place where the marriage was solemnized Example: If the wedding took place in Hyderabad, the court in Hyderabad has jurisdiction. Place where the husband resides at the time of filing. Place where the wife resides at the time of filing. This is an important privilege given to the wife — she does not need to file in the husband’s location; she can file from her own current place of residence. Place where the parties last resided together as husband and wife. Regarding address Yes, in the divorce petition, the wife must provide her current address if she is filing from her place of residence, because the court needs it to determine territorial jurisdiction and for sending official notices. However, if there are genuine safety concerns (e.g., domestic violence or threat from the husband), she can request the court to keep her address confidential or provide it in a sealed cover.

As a lawyer based in Bangalore, I advise that the jurisdiction for a wife to file for divorce in India, including Karnataka, depends on key legal provisions under the Hindu Marriage Act, 1955, or other applicable personal laws. A wife may file for divorce in the district court where she or her husband resides, or where they last resided together. Under Section 19, if the wife is the petitioner and has been deserted or is living separately due to the husband’s actions, she can file in the jurisdiction where she is currently residing, provided she has lived there for a reasonable period. Residency must be established, typically with documents like an Aadhaar card or utility bill. In Bangalore, the Family Court has jurisdiction over such matters. The wife’s address is generally mandatory when filing, as it ensures proper service of summons and establishes the court’s authority. However, in cases of domestic violence or safety concerns, she may request the court to withhold her address under the Protection of Women from Domestic Violence Act, 2005, with supporting evidence.

Can the wife file for divorce at her place of work? Her place of residence and place of work are in two different cities.
