Q: Child maintenance while spouse is separated

My husband and I have been living separately from past 6 months due to in-laws issues and We have a 2.5 years son. He didn't even tried reaching out to check upon his son well being. Now I want him to be responsible for his child needs and responsibilities. So I am planning to send a legal notice to him but what if he disagree or if he forces me to live with his family? Can he take any action saying that he wanted to stay but I asked whole family to leave(due to mental torcher for almost 4 years?

Advocate Rudrabhushan C Benakanalli answered
Dear Client, your situation involves a 2.5-year-old son and six months of separation due to in-law issues, with your husband showing neglect by not checking on your son. Under Indian law, particularly the Hindu Marriage Act, 1955, and the Guardians and Wards Act, 1890, you have a strong case for seeking divorce on grounds of mental cruelty, especially given the year-long torment you describe. His lack of interest in his child further weakens his position. You may proceed with a legal notice demanding maintenance and custody, citing his abandonment. If he disagrees with your intent to leave due to mental torture or forces cohabitation, he cannot legally compel you to live with his family against your will, as this violates your personal liberty under Article 21 of the Constitution. Regarding custody, courts prioritize the child’s welfare, favoring you as the primary caregiver. He cannot forcibly take the child without a court order, which he is unlikely to secure given his neglect. I recommend filing for divorce and custody immediately, supported by evidence of separation and his conduct.

Q: Suit for cancellation - when to refund advance received ?

We entered into a registered sale agreement (1 acre land in Kanakapura) for ₹1.86 Cr. Buyer paid ₹25 L advance. No forfeiture clause – time is essence and 3-month duration. Buyer is in default and it has been 8 months. We served termination and public notice. Our lawyer suggests filing a suit for cancellation after refunding the advance immediately. We feel it’s safer to ask the Court to direct the mode of refund, i.e. to buyer’s a/c or to Court’s a/c. Should we refund now or seek Court directio

Advocate Rudrabhushan C Benakanalli answered
Given the registered sale agreement for 1 acre land in Kanakapura (₹1.86 Cr, ₹25L advance, no forfeiture clause, time essence, 3-month duration), and the buyer’s default after 8 months, your position is strong. Having served termination and public notice, immediate refund to the buyer’s account or Court’s a/c is prudent, followed by a suit for cancellation. Seeking Court direction post-refund ensures legal safety, avoiding disputes over the advance. I recommend refunding now and filing the suit promptly to enforce your rights

Q: About my husband's impotency issue

My husband is impotent, he is not ready for checkup or not ready to talk with our family, I've a video of his father saying we took him for xxxx doctor for checkup theyve given tablet for 5days, they've sent notice for me to come back we replied whatever it is there, now they've sent notice from court.....will court ask him for checkup & get report?? What should be the next procedure

Advocate Rudrabhushan C Benakanalli answered
The court notice suggests legal proceedings, likely related to your husband’s medical evaluation. Given his reluctance and the video evidence of his father’s statement about a doctor’s visit and medication, the court may order a medical examination to verify his condition. Your next step is to consult a family law attorney immediately. Present the video as evidence and seek to compel his cooperation through court intervention. Ensure compliance with the notice by responding formally, and request a court-appointed medical evaluation if needed.

Q: NRI's Bangalore FLAT double sale

Flat was booked and sale/construction agreement signed in 2013. But project never completed with all legal CC or OC documents till date. Same flat is registered to someone else when ongoing the court case. I have consumer court order in favor for refund. But builder is not responding and paying the refund. I want to file criminal case from abroad. OR any methods to fastrack to get refund. Please advice.

Advocate Rudrabhushan C Benakanalli answered
Given your situation—a 2013 sale/construction agreement, an uncompleted project lacking CC/OC documents, and a flat registered to another party despite a consumer court order favoring your refund—your builder’s non-compliance is a clear breach. Filing a criminal case from abroad is complex due to jurisdictional issues, requiring local legal assistance in India. Engage a lawyer to enforce the court order via contempt proceedings or asset attachment. Alternatively, explore the Real Estate Regulatory Authority (RERA) for expedited resolution. Act swiftly to preserve evidence and escalate pressure.

Q: I want to know the validity of sale agreement for purchase

How many months will sale agreement be valid. I want to know the validity of sale agreement for purchase. Hindu

Advocate Rudrabhushan C Benakanalli answered
Under Indian law, particularly the Transfer of Property Act, 1882, which governs property transactions including those under Hindu personal law, a sale agreement for property purchase does not have a fixed statutory validity period. Its enforceability typically hinges on the terms mutually agreed upon by the parties, often ranging from 3 to 12 months, depending on the agreement’s stipulations. However, the Limitation Act, 1963, sets a three-year period from the breach date to file a suit for specific performance.
