What to do if 13A is going on and couple wish to go for 13B ?

Sir 13a divorce and other criminal cases are running. Now wife agrees for mutual consent 13b divorce. So for that wether i have to withdraw 13a which running? What if I will withdraw 13a and file new mutual consent 13b , but after that wife cheats or refuses for consent? Plz guide me.

Dear in ur matter first of all u have to take mutule divorce on stamp paper and also mention that thing she and u will withdraw matters if any as in date are going on than file mutule divorce and withdraw 13.a

If both of you are agreeable for divorce you have to get petition converted into 13B or you can file a fresh petition. It will take same time. In case you want to save time then the petitioner shall withdraw all the allegations and responden can give written consent for divorce by admitting petition and straight way court can pass a decree

Dont withrow your case , if she is ready to give divorce , put it on record and proceed in your case. you will get divorce. There is no need to withdraw the case and filing another case for mutual consent divorce.

Sir,
If she wants to divorce mutually then you both may request the Ld. Court for the same and the said petition can be converted into 13B. Then confirm that your wife agrees to withdraw other criminal cases pending. that can be done in the meantime.
