What can i do now? Will i have to apply immediately for divorce?

Myself married by dec '17.our marriage last about 9 months.i gave birth to baby boy.ow myself and husband living now apart for 7 months due to problems.. now ready for mutual divorce but he saying he will win child custody like that...but from
the day of birth of my baby..i only looking and raising him alone..he didnt even ask about baby health by phones... i want to keep him out of my child..pls suggest me.. still i didnt apply for any divorce. We are hindus.arranged marriage
the person question is very clear since she might be consulted before an advocate on this matter. mutual divorce proceedings is well for her. if not maybe contested divorce proceedings. the child custody case shall be filed separate.

yes, you have option to get divorce mutually. at the same time you have right to child custody till he attain 16 years old. Your husband only has a visiting right on Sunday or any other day. you have absolute right to hold children.

since the child is with you you are the natural guardian of the child, your husband nowb that accepted for consent divorce we can prepare a momorandum of understanding stating that all issues settled by way of a sitting before filing for mutual consent the child can be very well with you itself

you don't worry madam legally you only guardian no one come to legally and if you not interest to live with your husband mean you can file divorce along with child custody petition
