What are the rights of a wife before/after divorce.


12-Jul-2023 (In Divorce Law)
Wife left her husband because of physical violence. They are separated for past 2 years. She is staying in Pune and husband is in Gurgaon. They have two kids. Boy stays with husband and daughter stays with wife. Now husband is asking for divorce. Since the daughter is now 5years old we are looking for financial support from husband or maintenance for wife's and daughter future.

hi in this case it is unclear that whether wife needs resumption of marriage or dissolution. if she wants to restore her conjugal rights or wants divorce then she can approach family court she can claim maintenance for daughter's education, health etc. she can also claim maintenance for herself she can file domestic violence proceedings for residential rights, compensation, protection from physical violence

Yes you can file maintenance application for both wife and daughter for her daily and educational expenses. Even you can file criminal application under Domestic Violence Act. Also by filing transfer Petition in supreme court to transfer divorce Petition in Pune.

Dear friend, As per your information it's seems that husband want divorce from his wife. whether he has been filed divorce petition against wife? if not, wife can also file petition against her husband for maintanance of herself and her daughter too.
