If you have been cheated by your husband and in-laws thereby knotting you in the marriage tie with your husband on false and vague promises and other things, you may file the criminal complaint for cheating etc. against them. Second one remedy is available with you to file the divorce petition against your husband on the ground of cruelty etc. under the provisions of Section 13(1)(ia) of Hindu Marriage Act and other grounds, as the case may be. You may also file the proceedings U/s 498-A/406/34 IPC and 3/4 Dowry Prohibition Act against your husband and in-laws. For more details, you may contact me to have appointment for more discussion in your matter.

Dear Client

You can file a petition for divorce on grounds of cruelty where you can seek maintenance for yourself and your daughter as well. However, for better advice you may call to discuss more facts of your case. Feel free to call or meet me at my office.

Based on the information provided by you, a case for divorce can be made out on the grounds of Mental Cruelty. Other grounds may also be present, which looks like have not been stated by you.
Eating of tobacco in itself is not a good ground for divorce, however coupled with other factors which may be present Divorce may be possible.
Kindly share all the facts.
You will also have to deal with other law suits such as for the custody of your daughter.
