Q: Want to seperate from my husband or want a solution of my problem.
My husband drinks too much and use to eat tobbacos on daily basis. Whis affects my daughters (2.6 yrs old) growth. The environment of our house is worst as my father in law also drinks daily. They are nit even capable in paying our expenses. At the time of marrige they said that my husband never drinks and he is working in their relatives factory and all. Their bank balance is zero no any type of property. I have lots of issue. I want to seperate with him if dont stop drinking. Plz help me out

If you have been cheated by your husband and in-laws thereby knotting you in the marriage tie with your husband on false and vague promises and other things, you may file the criminal complaint for cheating etc. against them. Second one remedy is available with you to file the divorce petition against your husband on the ground of cruelty etc. under the provisions of Section 13(1)(ia) of Hindu Marriage Act and other grounds, as the case may be. You may also file the proceedings U/s 498-A/406/34 IPC and 3/4 Dowry Prohibition Act against your husband and in-laws. We did court marriage that none of our family members witnessed and nobody knows about it. Lived with our families separately. After 1 year we did hindu marriage that everyone knows about. If you would like to have divorce from your wife, you may file the proceedings U/s 13(1)(ia) of HMA against your wife seeking divorce on the grounds of cruelty and if you have some more grounds to seek divorce, Sections may add-on in that divorce petition. There are numerous grounds for divorce. Now, in your case, question arise that whether you are living separately from your spouse and if yes, then from which date because the date of separation is must as far as the divorce is concerned. Agar apka husband apko accept nahi kar raha hai to aap uske khilaf Restitution of Conjugal Rights U/s 9 of Hindu Marriage Act ki proceedings initiate kar sakti ho. No, without process of law, your husband or anybody cannot do so. The water and electricity supply are the basic amenities and no one can disconnect the same without process of law, as the case may be. If anybody does the same, you have legal right to initiate the proceedings against him and to get restore the essential supply of electricity or water, as the case may be, through the Courts of law by filing an appropriate case.
