Want to file child custody and need clarification on few things

28-Oct-2023 (In Divorce Law)
I have been married for 4 years and I have a 3 yr old son. My wife has taken my son to her parents house in April 2023 and filed a 498A complaint against me with false accusations. She was not even allowing to see my son. Now, I would like to file a petition for child custody along with visitation rights. I need clarification on few concerns with the same.

hi for filing child custody it is difficult as the child is of only 3 years and that courts would give it to mother but however you could file for vistation rights and also you could file quash petition against section 498A

yes you can file a case for child custody where the child is residing in that jurisdiction. so please an advoacte of your choice and file a case and ask for interim order for visitation rights of the child. so that child might not forget you.

The child will be given to the father, if the mother is unable to care for the kid. If the mother is mentally unstable, the father is the next person to get custody of the child. If the kid is 13 years old or more and shows a desire to live with his father, the court will give it to him.
