Q: FIR over forged sale agreement
I have filed a civil suit against person B for specific performance of the sale agreement. He filed a criminal case against me saying that the document was forged. He gave a statement that he gave us blank signed stamp paper for the rental agreement and we misused it as a sale agreement. Police filed a chargesheet against us. Can the police file a chargesheet solely based on his statement, The police did not ask statement of any witness signed on stamp paper(the agreement)?
Advocate Hemlata Nageshwar Pitlewar answered
Get it Quashed. In simplest terms, quashing of criminal proceedings would mean ceasing the legal machinery which had been set in motion. This is usually done after a First Information Report (hereinafter referred to as FIR) is filed, before the chargesheet-filing stage.
