Want to apply for mutual consent divorce

Hi ... I wan to apply for mutual consent divorce ... so what’s the procedure ?? How to get the paper work done and submit to the court

Mutual Consent Divorce Petition can be filed in the family court if both the parties have agreed to take divorce and there is no force or pressure or fraud for such consent.
We will require the details and documents to drafting the Petition.
Once drafting is complete and the same is confirmed by both the parties including custody of kids and alimony or maintenance issues , then the same will be filed in the court.
Then the Judge will take the first hearing.
It will be sent to the counsellor.
After the report of the counsellor, second date after period of six months will be given by the court.
On the second date, the Judge will again verify the decision of both the parties for the divorce and then the order of divorce will be passed by the Judge.

1. You will have to approach a local lawyer;
2. Collect all the proofs of your marriage;
3. You will have to come to terms with the maintenance, the custody (if any), division of property etc.;
4. This should take around maximum 7 months to finalise.

First important thing required is your spouse free consent for Mutual Consent Divorce Petition.
Either you may appoint common advocate for both or independent advocate for each.
Appointed Advocate would prepare a required draft and would file in a Court properly.

Mutual Consent Divorce is the most convenient way to dissolve the marriage. You should approach a lawyer and draft a petition under s. 13B of Hindu Marriage Act. After the petition is filed the matter will come for hearing and court shall appoint counselling sessions to save the marriage. Based on reports of counsellors the matter is decided by the court.
