Dear client, To file a Section 9 petition under the Hindu Marriage Act, 1955, follow these steps: 1. Drafting the Petition – The petitioner (spouse seeking restitution) must file a petition in the family court stating that the other spouse has withdrawn from their company without reasonable cause. 2. Attach Supporting Documents – Marriage certificate, proof of separation, attempts at reconciliation, etc. 3. Filing in the Family Court – Submit the petition at the appropriate jurisdiction where the marriage was solemnized or where the couple last resided together. 4. Court Proceedings – The court will issue a notice to the respondent spouse, conduct hearings, and may refer for mediation before deciding. 5. Final Order – If the court is satisfied, it may pass a decree for restitution. However, if the respondent does not comply within one year, it may be grounds for divorce under Section 13(1A)(ii). you need to file under section 9 of hindu Marriage act, if your spouse is deserted your society without any reasonable excuse. you can file. the process is very simple..once you decide it . you have to file it in district court

firstly you send legal notice to him/her after 15 days of Legal Notice reciept you can file petition under section 9 of HMA. This petition will be file before family court accordingly territorial jurisdiction of the court Thank you Regard Advocate Sandeep Vats &Team
