3. Filing in the Family Court – Submit the petition at the appropriate jurisdiction where the marriage was solemnized or where the couple last resided together.
4. Court Proceedings – The court will issue a notice to the respondent spouse, conduct hearings, and may refer for mediation before deciding.
5. Final Order – If the court is satisfied, it may pass a decree for restitution. However, if the respondent does not comply within one year, it may be grounds for divorce under Section 13(1A)(ii).

firstly you send legal notice to him/her after 15 days of Legal Notice reciept you can file petition under section 9 of HMA. This petition will be file before family court accordingly territorial jurisdiction of the court
