Want advice on Separation document

18-Oct-2023 (In Divorce Law)

My parents has been separated since 2008. I am living with my mother and we are not in contact with my father since that time. They never took divorce legally and hadn't any marriage certificate too. I need an alternative document now to prove their separation for applying overseas scholarship. They are asking for either divorce paper or death certificate of father if i would be unable to submit his citizenship proof. Plz help

कृपया आप यह बताएं कि क्या आवेदन करते समय आपके द्वारा अपने माता पिता की वैवाहिक स्थिति के संबंध में उनके अलग अलग रहने की बात की गई है यदि उनके अलग रहने की बात की गई है तो आपकी मां की ओर से हिंदू विवाह अधिनियम की धारा 10 के अंतर्गत न्यायालय में एक वाद दाखिल किया जा सकता है और उस वाद के आधार पर आप स्कॉलरशिप के लिए अप्लाई कर सकते हैं

You need to answer these questions before u get a valid answer....1.what religion u belong? 2. when did ur parents got married? it is always never necessary to get marriages registered so if you answer these two questions I can help you in giving you a correct answer also tell me if your parents are of similar region or are there from different religion also what is your date of birth

Marriage will not come to an end automatically. lack of marriage certificate is not mean that marriage didn't happen. I'll advice you to ask your mother to ask for divorce by mutual consent. In case he is not ready for divorce by mutual consent then you can directly go to Supreme Court for Irrevocable breakdown of marriage.
