Firstly tell me on what ground he send you the notice of divorce and do you what to give him divorce.?? You will get the proportion in his property and even now you can ask for monthly maintenance. Your husband has right to ask for restitution of Conjugal rights.

Is it possible for first wife to seek declaration after death of her husband ? If yes, pls recommend latest ruling and what other remedies are available for first if second wife claiming her share in the property

If the suit of divorce is pending in the court and no decree is passed then now suit can be come to an end as it is a personal matter and one party of the suit is dead so there is no subject to the suit left. If second marriage commence before the end of the first marriage then second wife don't have any right in the property of the deceased husband.

No you can not file divorce on this ground. Firstly you have to send notice for restitution for Conjugal rights if she will not came back after that then it will become a ground that she is withdrawn from the marriage without any reasonable ground. Try to show the court that you are interested to keep this marriage and not wanted to file the divorce



Q: Want advice on Separation document

My parents has been separated since 2008. I am living with my mother and we are not in contact with my father since that time. They never took divorce legally and hadn't any marriage certificate too. I need an alternative document now to prove their separation for applying overseas scholarship. They are asking for either divorce paper or death certificate of father if i would be unable to submit his citizenship proof. Plz help

Marriage will not come to an end automatically. lack of marriage certificate is not mean that marriage didn't happen. I'll advice you to ask your mother to ask for divorce by mutual consent.In case he is not ready for divorce by mutual consent then you can directly go to Supreme Court for Irrevocable breakdown of marriage.
