Transfer of Matrimonial divorce case to a different state

i would like to transfer Matrimonial divorce case from Hardoi UP to Mumbai. as after marriage me and my husband was working in mumbai since last 10 years. 3 months back my husband left me and file divorce case at his home town. i am working and have 6 year old son. i would like to transfer divorce case from UP to Mumbai. Please suggest.

Better for you to file a proceeding against yOur husband at Mumbai . Summons will be issued to your husband by the Mumbai court and there after you can proceed with the matter here by stating that you live in Mumbai etc

You can do that by filing a Transfer petition under section 25 of civil procedure code to Supreme court since it is inter- state transfer. It may take a time of 6 to 8 months for the process and you have to give reasons for transfer.

The only option available to you is to move the high court and ask for relief
The high court will pass an order and pertaining to that order the lower court will transfer the matter to the jurisdiction of Bombay swing the importance of the transfer
And also the intention of the husband

Hello Mam,

In India, ladies have right to transfer the case to their places. For this you should file a transfer petition requesting transfer of the case to your city by stating that you are unable to come to husband place. you can contact me for further help required in Mumbai.

This is my response to you:
1. You will have to file transfer petition in the supreme court;
2. Since the transfer is happening from one state to another;
3. Approach a local lawyer and do the same;
4. State all the reasons and more for the court to award in your favour.
