Sister husband married second women without divorcing

our sister got married in same religion( hindu)she has 13 yrs of marriage with 2 kids age 12 and 6 yrs old. Our sister husband told us he has married second women without divorcing and informing us. Now he is forcing and mentally torture our sister to give divorce or allow him in writing so that he can stay with the second women. He may also planning to convert himself into Muslim and legalize his second marriage. Or he is saying if the second women complaint I will get 3 months imprisonment hardly and after that he will file divorce case against our sister. He is also befooling us by saying he is mentally ill and going to different psychologist doctor and get prescriptions and took high dosages of medicines and threatens us of suicide and killing of our sister. At the same time he message to the second women I am working on our plan and need some more time to be successful. She said OK please advice us on what legal action we can take against them to save our sister and her kids.

Firstly, take your sister out of that person's home. File for a divorce on the grounds of cruelty u/s 13 of HMA. Second, file another case of domestic violence under the appropriate act along with criminal intimidation. The husband legally cannot marry another female without divorcing the first one. It is illegal in Hindu law and if he converts then it automatically becomes a ground for divorce. Try to get an F.I.R registered against that man in a local Police station against the threats so that you can furnish proof in the court of law.

File a case against the husband of your sister regarding the threats that he is giving, about his second marriage without giving divorce to your sister. File a case in the name of your sister and her kids asking maintenance for her husband for their daily survival. file a case of domestic violence agaisnt the husband if there has been any offence.
