Shared Right on property of Wife if property is on Husband'sname

Married for 8 years my daughter been contributing to flat purchased on her husband's name.even her PF been withdrawn and nothing is left in her bank account. Girl is Sikh,n boy from Hindu Brahmin family. she is earning nearly 1.2 lac per month as salary from her govt job. Couple have a 5 year old daughter. how to ensure that wife is financially secure in the event of a divorce. as there is lot of disharmony prevailing . they behave like Shylock.

Your daughter can file domestic violence act case against her husband and In laws.Dear client ur daughter can also filed CAW cell complaint against her husband and In laws under section 498A and 406 IPC and for share in the house she can file civil case if she make payment for purchase of that house if ur daughter has some proof regarding this. she can seek for ask for alimony and maintenance, wherein the she can also claim the amount paid by her through a transaction in favour of the bank for the house, u can also ask for the maintaince for the child education and monthly consideration.

In this regard, you need to provide me with more details, first of all you need to understand that as you have daughter then you require a house for yourself and her, therefore you need to secure the evidence with regard to his property and his ancestral property. if there is disharmony of a sort wherein she is physically harassed then you can go for filling of DV petition and then get protection order. Dear Client,
You daughter must have perfect decision of about what she wants to do , either interested to divorce alone or mutual.
if not mutual then she will have to move for divorce.
whereas , EMI which she is paying for flat there must be proof for. Here you have not said about her husband, what he is doing, if he is in job or unemployed or doing business, where he is settled ? Hence before saying anything both side has to be understood.
