Second marriage without diverse
25-Feb-2025 (In Divorce Law)
Women cheated me and get married(2 months in relationship) with me when her diverse case is pending(till today), they shown me some bond paper where her husband and her written separation document. They not told me that, they told no cases exist in court and cheated me. Is it a valid marriage, now she is threatening me she will file 498a case, is it valid to file 498a, is she eligible for allimony.
1. Is Your Marriage Legally Valid?
No, your marriage is not valid if her previous divorce case is still pending. Under Hindu Marriage Act, 1955 (Section 5 & 11) or Special Marriage Act, 1954, a person can remarry only after obtaining a final divorce decree. Since she was still legally married when she married you, your marriage is void (not legally recognized).
2. Can She File a 498A Case Against You?
Section 498A IPC (Cruelty by Husband) applies only to legally wedded wives. Since your marriage is void, she cannot file a valid 498A case. However, she may still file a false case, so you should:
Collect proof of her pending divorce case to show your marriage is void.
File an anticipatory bail application (if she threatens you with 498A).
File a criminal case for cheating (Section 420 IPC) & misrepresentation.
3. Can She Claim Alimony/Maintenance?
Since your marriage is void, she is not legally eligible for maintenance under Section 125 CrPC or Hindu Marriage Act. However, she may attempt to claim under:
Protection of Women from Domestic Violence Act, 2005 (she may seek compensation even in void marriages).
Maintenance under Section 25 of HMA (if court considers marriage in good faith).
What You Should Do Next:
File a Case for Annulment – Since the marriage is void, seek a court declaration under Section 11 of HMA.
File a Complaint for Cheating (Section 420 IPC) – If she misrepresented her marital status.
Gather Evidence – Collect her divorce case details, bond paper, messages, etc., proving misrepresentation.
Apply for Anticipatory Bail – If she threatens a false 498A case.
