Regarding Alimony and compensation of my personal things broke by husb

Hi I am a Sunni Muslim from Maharashtra....facing domestic violence since the 3rd day of my marriage the marriage is performed on Nov 2024 after that husband and his family mentality torturing me now in laws family forcing me to give khula but I don't want to give khula I want alimony and maintenance because I have lot of loss because of husband also he takes drugs and also hits me he taken loan on my credit card and now I am paying the loan installments also he broke my things including laptop

Dear client based on the query if you are facing domestic violence then you should go for a legal action u/s 498 IPC/85, 86 in BNS. As you are mentioning he is a drug addict then the matter can be discussed and can bring charges on him. Do not give khula as you have your legal rights. To get maintenance from your husband in India, a wife can file a petition under Section 125 of the Code of Criminal Procedure (CrPC) or the Protection of Women from Domestic Violence Act, 2005. The court will then consider the husband's ability to pay and the wife's needs when determining the amount of maintenance. you can also file dowry harassment case against husband and in laws

Well, if you don't want to give Khula, then no one can force you, you can seek Maintenance from your Husband by filing a case in Court under Sec 144 of the BNSS Act, 2023 + you can seek Maintenance in DV Proceedings too by filing a case of DV Act, 2005.
