RCR decree, execution, divorce file

I have got rcr decree my side(husband), in the judgement copy clearly mentioned to join (wife) within 60 days.nBut still she not joining(60 days completed), also interim maintenance awarded to pay 7k in maintanence casennWhat will be the next procedure?.n1. Can I file execution petition?n2. After receiving execution petition reply, can I file divorce petition or need to wait for one year completion of rcr decree to file divorce petition ( Because 60 days time period given in rcr judgement copy).

Yes it is possible to file an execution petition under court of law. There is a time limit of 60days for returning. If the said time is barred means u can file a divorce petition.
The rcr petition which u got order was it contested decree or exparte decree need to be discussed

Your eligibility to file for divorce for non compliance of degree in rcr does not depend on outcome of execution petition which means you can straight away now file for divorce. There is no need to wait for 1 year after the decree.

Dear Sir,

Since Restitution of Conjugal Rights judgment is in your favour. You need not pay any maintenance. Produce the said copy before the Court which directed you to pay the monthly maintenance of Rs.7,000/- and ask it to recall the said order in view of above judgment. You have to file Execution Petition and wait for 1 year from the date of judgment and then file Divorce case if your wife did not come to your house.

after 60 days you can file divorce petition or issue notice on the based on decree if they not responding than you file direct divorce petition and is there any seperation more than 2years if yes than also you will get the divorce and i want know when you got married
