1. Is it necessary to hire a lawyer to have a divorce? If yes, what is the minimum fee? 2. What is the minimum possible time for divorce process? 3. Is it mandatory that spouses are supposed to live separately for a year? What if they live together and decide to separate suddenly?

Query perused. Yes it is necessary to engage a lawyer for obtaining a decree of divorce since it technical. In case of divorce by way of mutual consent the time period would be 6 months. However, in case it's a contested one, it depends and might take 2 years aswell. Yes it is mandatory for spouses to live separately for 1 year. For mutual divorce 1 year of seperation. For divorce on other grounds 2 years or more than 1. If residing together, divorce can be filed in the ground of cruelty (very less chances, if residing together) or it can be mutual divorce.

Under Section 13-B of the Hindu Marriage Act, 1955, the parties can seek divorce by mutual consent by filing a petition before the court. Mutual consent means that both the parties agree for peaceful separation.
