Quashing of fir 498A which filed against me

17-Mar-2024 (In Divorce Law)
Sir, my wife filed a 498a fir against me. But in 125 crpc case she didn't mention anything related to demand of dowry. Can I use her 125 crpc petition in 498a quashing in High court,?

yes, you can use the 125 crpc petition filed by her against you in quashing the First Information Report lodged by your wife in the Hon'ble High Court. apart from this you may also file all the evidence which you have in defence of 498A.

High Court will not grant relief in this case. instead it will ask you to move a discharge application before the trial court and have it decided in accordance with law. if you go to High Court, the same will refer the matter to mediation and you will have to deposit the sum of money

no actually the facts this closed in 125 CrPC per maintenance is not taken as a conclusive evidence collaborated further the trial starts but yes it can be a base FIR in the High Court and further I will suggest that you must and there after a divorce petition proactive step rather than defending yourself
