Process of mutual consent divorce

Hi, Me and my husband are living separately since 1 year and we both have came to a conclusion that we should get separated by mcd. We have agreed on all the terms and have no point of disagreement between us. My question is how can we proceed further now? Do we need to hire a lawyer for the same? Please help with the procedure. Thanks and regards

Hello, since you have agreed to mutually to part ways, you need to approach a local lawyer and file a petition under sec 13 B under Hindu Marriage Act to grant divorce. Yes you can file case for mutual divorce in court after that counselling sessions are there, after six months again court can ask both husband and wife about their decision about the mutual divorce then it will pass the decree of divorce.

Yes you need to hire a lawyer. If you are hindus then you can take mutual consent divorce under section 13 B of hindu marriage act, 1995 and for other religions their respective perosnal laws will be applicable. If you are residing in a metropolitan cities then you can file a divorce petition in family court and if you residing in rural area then before civil judge senior divison

If both of you are agreed to go for mutual divorce and terms and conditions are finalise then you have to file joint petition within local jurisdiction of court. For complete entire process you have to appoint lawyer
