Procedure to file divorce on grounds of cruelty

I, the husband, have self acquired property before marriage and also the ancestral one. in case of divorce, what will happen. Presently, we are living in ancestral property. Can we legally take some other property on rent and move out of the ancestral property. Is it possible to file the divorce from the husband's side on the grounds of cruelty to my mother and myself. how to proceed.

First get transferypur all properties on persona name upon him/her you may rely upon.

If you file divorce and if wife appears then as per your property computation court will fix mainntenace and in case if you succeed in divorce then court pass permanent alimony as per your property value.

Yes you can file divorce on the grounds as mentioned by you. Try to get properties in your name transferred to some other family member and then you may shift to rental accommodation. File divorce as early as possible because it will take few years.

Certainly you can file divorce petition on account of cruelty. If your ancestral property is the matrimonial home no need to move out of same by you or your mother and as far as you are having share in same. With regard to self acquired or ancestral property's disposal in final settlement with your wife in the end of divorce litigation, if any, it is the court's prerogative to pay to your wife from any of your property as permanent alimony. Same may be in the shape of lump sum cash or kind also or may be monthly amount also subject to final approval of Court, in the facts & circumstances of the case.. You can move on to file divorce petition on ground of cruelty or other relevant grounds in the light of peculiar facts of your case.

well sir the general rule is that what ever property you have in your name will be distributed and yes you can move out of the property any time and according to the recent judgments the scenario is that legally wedded wife does not cooperatively live in the husbands family you always have an option to file a divorce.

You need to collect all the confirm evidence of cruelty from your wife side. you can collect the evidence by paper or by any means. do collect it before filling divorce petition.
you should have sufficient and authentic proof to file divorce petition.
