Q: DV case by bros wife after his death

MY BROTHER WIFE HAD FILED A DV CASE AFTER HIS HUSBAND DEATHDISTRICT COURT ORDER MAINTANCE TO HER FROM BROTHER IN LAW(ME).BROTHER'S WIFE ONLY RESIDES WITH US ONLY IN HER PREGNANCY PERIOD.SHE ALSO FILED 498 A , DV ,CIVIL SUIT IN DIFFERENT CITIES TO HARASS US.WHAT SHOULD I DO TO AVOID MAINTAINANCE. WE LIVED IN AMRITSAR & HER MAYKA IN CHD.& & BEFORE DEATH OF MY BROTHER SHE WAS LIVING IN NOIDA .PLEASE HELP US

you will have to share the documents of all the cases which have been file against you it can be seen that dismissed by the court at the earliest being not onvalid ground or just just to make harassment to you and the maintenance case which have been hi lagne se You and maintenance has been ordered should be challenged because there is no such as toy you should pay maintenance to the wife of brother who is already dead you can share your documents with me and I can advise you father on it

Q: Remarriage while going case in court

Can a provision for second wife too remarry to another person except her husband if the first wife is still alive and second wife a child when the case of domestic abuse and marriage null and void is going on in court

yes it has become a common trend these days to remarry while the court cases are still pending but it is very much important depending case to case weather you shold get a concent of the spouse or permission from the court itself to proceed further

Q: My wife file a domestic violence case against me and my family

Hello sir/madam,My wife file a domestic violence case against me, my father ( who is blind) , and my sister ( who is married in other city. What I can do? We are do nothing with her. But she make a fake case against us. How I protect my family from this .

Quashing can be filed against the charges on father and sister in the High court to cancell the FIR or Droping of charges can also be prayed before the court. If the lower court does not agree a revision can be bought before the high court to drop charges. as per your situation there are good chances of success

Q: I am working as a teacher ,living with my only son and parents

I am married from last 21yrs but now I am staying away from my husband from last 2 yrs as during my marriage period i went through a lot of mental trauma.But when he was abusing me in front of my son i decided to leave him and start a new journey.we dont talk on phone but he comes to my place to meet his only son.But he is paying only 25 thousand monthly to me which is not enough for us.I want to put up a maintence case against him but want to know the consequences

Depends on the income of the husband and the age of the child what amount may be decided by the court. In most cases where the mother is upbringing a child she is entitled to around half of the husbands income or may be more depending on expenses. There is no negative consequences for the wife.regards

Q: How to claim equal contribution by husband in the family expenses

My husband does not want to bear household expenses of me and my two kids stating he is not liable for it.do I have any legal support in this case?

yes you can file for maintenance under section 125 crpc and ask for fixed maintenance from your husband through court. Although it is a criminal proceeding but it has been made so . so that the husband can be force to pay
