Possibility of mutual divorce joint petition with fake marriage date

20-May-2023 (In Divorce Law)
I recently got married in dec 2017. We both decided to take divorce. She has sent an agreement stating some clauses and told we can show our marriage took place on dec 2016. And then can apply for mutual divorce. Is it possible??

Though it is possible but we never suggest such things because it is misleading to court and the court may punnish you for providing wrong information on oath. No advocate of prudent mind will suggest such things.

Feel so sad that the marriage did not last too long. Giving false evidence like changing date of marriage etc is perjury for which punishment of jail or fine can be given. in court you have to give affidavit on oath Of truth

I have gone through your query. Back-dating of your marriage date shall constitute an offence under Indian Penal Code, 1860. It is not at all advisable to commit such an offence and it is further advised that please don't try to be-fool the Court and as soon as you agree to same, you will also become the party to the same offence.

Regards.

As per law, for the filing of divorce petition minimum one year must laps from the date of marriage. By showing some documents which are not a genuine document this amounts to playing a fraud with the court. I would suggest you wait for few months then file a divorce petition under section 13B i.e, divorce by mutual consent.
