Please confirm : Response for Divorce Case files by Wife

02-May-2023 (In Divorce Law)
My wife has filed a divorce case against me on grounds of mental cruelty and asked for big amount in alimony. but in reality she deserted me . In response can i say that i am okay to give her divorce since she deserted me and not willing to pay any alimony since she is working. nnI consulted one lawyer and he said that either you have to accept all of her 3 conditions(Divorce, You did cruelty & give he big alimony) or reject all 3 conditions( Don't want to give divorce, you did not do cruelty & you don't want to pay alimony). nnIs it right ?

Every advocate has it own working way. First you need to fight back if you are innocent, during the trail you need to show her capacity of earnings in an intellectual way. Few things can b sorted in mediation or with time things can b favourable. But if u need spontaneous result then most inevitably you will put hammer on your own feet. Have patience & proceed gradually with the case.

No…that’s your own choice what do you want to do. If you accept that you did cruelty then means you have committed an offence against her. And if she’s earning and is capable of maintaining herself then you are legally not liable to give her alimony. For more legal assistance I am just a call away.

If she has deserted you and trying to reap the benefits of her own wrong then you should contest the case. Also alimony and divorce are two different subjects, it’s not mandatory to give alimony in all the cases. However complete facts needs to be known. For any further legal assistance please feel free to contact. Thanks

It’s not that you’ve to accept all or nothing. Alimony is decided after considering many factors one of which is the earnings of the wife. If she’s earning good then the court may either refuse to grant alimony or may also grant a lesser amount compared to what she had received had she not be working. The amount for alimony will also get affected by the fact that she was the one who had left you. If you’re able to convince the court that she had deserted you then that could be a big blow to her claim for alimony. Please contact for any further queries.
