Hi You can file a maintenance case in the Honourable Court. U/S 125 CrPc. The court can order the husband to pay monthly financial support to both wife and child. You can also go for protection under Domestic violence Act (2005) Even if you are not living with him now, if there was abuse or neglect You can seek for :- Monetary relief, Protection orders and Residence rights. This act offers strong legal protections for women facing abandonment or abuse. You can also go for Divorce or Judicial separation On the ground of desertion ( living separately without reasonable cause for two plus years.

I understand this must be an extremely difficult time for you, especially with a child to care for alone. Since your husband has abandoned his responsibility and cannot be reached, you have strong legal grounds to file for divorce on the basis of desertion and cruelty. You can also claim maintenance for yourself and your child, even if his current address is unknown — the court can help trace him or proceed with publication notices. I recommend scheduling a consultation so we can discuss the best steps to protect your and your child’s rights and ensure financial support.
