need to file for divorce for mutual consent

husband need to file divorce for mutual consent. 2011 we got married 2 daughters age 7 & 12 studying in govt school. due family issue she stopped doing house hold things for me and not even speaking for 3yrs. she only cares chidren i am paying them around 10k monthly, my salary 25k. we staying in my mothers home. i dont have any property. sridhan is with my wife only. she is not ready to go any job or work. many times i tried to speak but she is not willing. what shall i do?

hi, I can well understand your concern from the query raised, kindly ponder over and once you have resolved, you can file for divorce by mutual consent, however your wife should provide free consent for this divorce inorder for it to materialise, you can contact me for further clarifications!!

sir, i can understand that you. are not in understanding life with your wife. yuo have not shared whether you are living under one. roof. you are generously paying₹10000/ for your family. please don't stop that keep a record of your payment. you have to issue legal notice to your wife. only then she will express what she needs and what is in her mind

S Gunasekar advocate answer You can file for divorce under mutual consent only if your wife agrees. If she doesn't, you may file for contested divorce under grounds like mental cruelty or desertion. Divorce by mutual consent requires unwavering consent of husband and wife. If your wife consents for divorce then you can go ahead with the procedure. Otherwise, you have no other option but to file a petition for divorce which will be contested by your wife.
