Dear client, If your name has been falsely included in the complaint, you should immediately seek anticipatory bail under Section 438 CrPC to prevent arrest. Engaging a separate lawyer from your brother-in-law is advisable if your defenses are different or if there is a potential conflict of interest. Your lawyer can file an anticipatory bail application in the Sessions Court or High Court, highlighting the lack of evidence against you. If the complaint is completely false, you may also consider filing a petition for quashing under Section 482 CrPC in the High Court.

Answer to that question would actually depends upon the specific facts of the case and the difference or similarly of role assigned. You can opt for a detailed consultation and discuss the case in detail and thereafter answers can be correctly arrived at. On the question of anticipatory bail, for you it should be more important to know whether to file anticipatory bail or not. The process shall be taken care of by your lawyer

Yes you can hire a separate lawyer who can represent you in court. Who all are being involved in the complaint other than you is required to be looked into. These days anticipatory bail is not required in a 498A case. Rest it depends on the charges

You all can file anticipatory bail through a common advocate before the court and firstly need copy of FIR and all statements of complainant then file anticipatory bail before competent court. For further inquiry you can visit my chamber or office. Regard Sandeep Vats Advocate
